We operate the Canbe platform, a digital tipping service leveraging RFID/NFC technology for secure, cashless tipping in the UAE (the “Platform”), including
Mobile apps for Customers and Employees
A web app for Businesses
Related services and programs
By accessing, downloading, registering for, or using the Platform (including scanning RFID/NFC tags, processing tips, or participating in rewards), you confirm that you have read, understood, and agree to these Terms, our Privacy Policy (incorporated by reference), and any other policies posted on the Platform.
If you do not agree, you must stop using the Platform immediately.
These Terms apply to all Users:
Customers (tippers)
Employees (service workers)
Businesses (e.g., restaurants, cafes, hotels)
Definitions
Business – A UAE-registered entity using the Platform for RFID/NFC management, employee oversight, analytics, and compliance.
Customer – An individual providing tips via the Platform.
Employee – A verified UAE-based service worker receiving tips.
Platform – All Canbe apps, websites, RFID/NFC tags, APIs, and related services.
Tip – A voluntary, irrevocable, non-refundable gratuity processed through the Platform.
Service Fee – Our 3% fee on each Tip.
User Content – Any data, profiles, or information you submit.
Eligibility and Registration
To use the Platform:
1. You must be at least 18 years old (or the legal age of majority in your jurisdiction) and capable of forming a binding contract.
2. Employees must:
Hold valid UAE work permits/residency visas
Be verified via UAE government APIs (e.g., UAE Pass)
Businesses are responsible for ensuring compliance.
3. Businesses must:
Be UAE-registered with a valid trade license
Comply with UAE employment laws
4. Customers must:
Have a valid UAE-linked payment method
International/tourist users must comply with applicable laws
Registration Requirements:
Provide accurate, complete information
Consent to electronic communications
Accept that electronic signatures (e.g., clicks) are binding under UAE Federal Law No. 1/2006
Maintain account security (passwords, device protection)
Notify us immediately of any security breach
Verification:
We may perform KYC/AML checks under UAE Federal Law No. 20/2018. We reserve the right to refuse, suspend, or terminate access without notice for violations, suspected fraud, or legal requirements.
Platform Services
We provide
Customers – Tip processing via RFID/NFC scans, tip history, worker validation, rewards/referrals.
Employees – Tip tracking, profiles, training, ratings.
Businesses – RFID tag management, analytics, reports (tip visibility only; no fund access).
Administration – Monitoring, compliance, incident response.
Important
Tips are sent directly from Customer to Employee (minus Service Fee)
We facilitate but do not store funds — we are not a bank or financial institution under CBUAE regulations
All transactions comply with PCI DSS and UAE payment standards
Fees, Payments, and Taxes
Service Fee
3% per Tip (deducted automatically)
Payments
Tips are voluntary and processed via linked payment methods
Recurring charges (if applicable) require authorization
Disbursements to Employees occur [e.g., weekly], subject to verification
Non-Refundable
Tips are irrevocable unless a proven technical error occurs (our sole discretion)
Taxes
You are responsible for all applicable taxes (VAT, income tax)
We may report to authorities as required (e.g., thresholds like AED equivalent of $600)
Chargeback Policy
You agree not to initiate chargebacks for legitimate Tips without contacting support
Unwarranted chargebacks may result in account suspension and reimbursement for costs (up to AED 500 per incident)
If a dispute occurs, you must provide evidence (receipts, communication logs) within 10 days
User Obligations and Conduct
Users must
Comply with UAE laws (PDPL, AML/CFT, sanctions lists)
Provide accurate data and ensure verification of Employees (for Businesses)
Protect RFID/NFC tags and devices from misuse
Not engage in fraud, tip manipulation, hacking, or interference with the Platform
You agree to indemnify us for breaches. We may monitor activity for compliance.
Rewards and Referrals
Users must
Participation is optional (opt-in)
Rewards are non-transferable and non-exchangeable
Rewards expire after 12 months
We may revoke rewards for abuse or policy violation
We may modify/terminate programs without liability
Privacy and Data Protection
We comply with UAE PDPL (Federal Decree-Law No. 45/2021) and align with GDPR/CCPA/DPDP principles.
Your rights
Access, correct, erase, or port your data
Object to certain processing activities
Withdraw consent at any time (may affect service)
Our commitments
Use encryption and role-based access control
Minimize data collection and anonymize analytics
Transfer data internationally only with safeguards

Intellectual Property
All Platform content and IP belong to Canbe
You receive a limited, revocable license to use the Platform

We are not liable for
Tip amounts or service quality
Interruptions, errors, viruses
Third-party actions or inaccuracy of analytics
Limitation of Liability
Maximum liability: total Service Fees paid by you in the past 6 months
No liability for indirect, incidental, or special damages
No liability for delays caused by banks, regulators, or force majeure
Indemnification
You agree to indemnify and hold us harmless from claims, losses, or damages arising from:
Your use or misuse of the Platform
Your breach of Terms or laws
IP infringements caused by your content
Corporate Social Responsibility
We allocate part of our revenue to UAE charities (listed at www.canbe.ae). This creates no contractual rights or liabilities for Users.
Termination
We may terminate or suspend accounts without notice for violations.
You may terminate at any time via account settings.
Outstanding obligations survive termination.
Dispute Resolution
First, resolve disputes via good faith negotiation (30 days)
If unresolved, binding arbitration in Dubai under DIAC rules (one arbitrator, English language)
No class actions or representative proceedings allowed
Loser pays costs
Force Majeure
We are not liable for delays caused by events beyond our control (e.g., wars, pandemics, cyber-attacks, government actions).
Governing Law
These Terms are governed by UAE laws.
Exclusive jurisdiction: Dubai courts.
Miscellaneous
Severability : Invalid provisions do not affect the remainder
No Waiver : Delay or omission is not a waiver
Assignment : We may assign rights; you may not without consent
No Third-Party Beneficiaries : Only you and us
Entire Agreement : These Terms supersede prior agreements
